Maybe she's putting herself forward as a sacrificial lamb to see what sort of fight W will have when it comes time to name a new Chief Justice?
And/or she knew the fight to replace Rehnquist will be so bloody and drawnout, she wanted to get while the getting was good -- no justice is going to want to leave while there's any turmoil associated with replacing Rehnquist. Yeah, a conservative nominee and the likely promotion of Scalia to the Chief Justice will change the complexion of the court dramatically. |

The replacement of Rehnquist (who is already conservative), with a conservative won't change the court much. The replacement of O'Conner, a centrist, with a conservative will start the push of the court to the extreme right but won't get it there.
One more replacement of a centrist or liberal after those to are replaced would put the court over the edge. I think the replacement of O'Conner will start the battles, more so than the replacement of Rehnquist. |

Well I do think attempts to load the court with those of certain political beliefs (that was what my FDR reference was about, incidentally, if that was too telegraphic) have been shown to be not very successful as the justices have historically shown a tendency to go their own way rather more than their nominating presidents might like after being put in place. And I can certainly see more moderate tendencies in O'Connor than in Rhenquist, for example.
However I think the past couple of decades have seen a considerable shift to the right in the U.S. with respect to the meanings of the words liberal, moderate, conservative such that they appear to me now to indicate what we used to indicate with the words moderate, conservative, reactionary in the past, respectively. I know this may shock many people, at least based on the continual use of the word and railing against the beliefs it is seen to represent, but I'm hard pressed to find anyone in office or the public eye in the U.S. today who to my mind is accurately described with the word liberal. For example, a true liberal to me doesn't even give a second thought to debating a proposition to guarantee health care for everyone, as doing that is a given without any discussion necessary to any true liberal. I am a conservative and am for universal health care. The problem is that in the US people demand every cutting edge treatment all of the time and without rationing costs could not be contained. I know people that get monthly pet and ct scans. Also Americans demand diagnosis and treatment in a timely fashion. I am not familiar with the Canadian or other models, however it seems like the waiting period to see a doctor is quite long at times. I fear that the people screaming the loudest for universal health care will be the same people screaming the loudest once they have universal health care. It reminds me of when the FDA fast tracked the drug approval process and you had people saying that the government was killing us because they were not approving drugs fast enough. I would make a wager that many of these same people are now screaming about the government killing us because we are approving drugs too fast. anyway, let the games begin. I love politics, its a lot like pro wrestling or the christian broadcast network, good for a laugh but not to be taken seriously.

The Democrats have moved further to the right since Clinton's success in getting elected and his "takeover" of the Democratic Leadership Council.
