I am relieved that you weren't in anyway near this clown during the melee and that you're not hurt. I'd think you've definitely got grounds for eviction. Have you got a decent deposit you can keep? That might cover the window and floor cleaning. Most of all you're okay and you wisely pre-prepped the lasagna and shells. ![]() I'll be thinking about you. Jason |

Awww Karen...this is awful. I am glad that David helped you out and you are doing OK. He is a great guy. As for the idiot who broke into one of your apartments, you should kick his ass out of there plus press charges.

Here a case like this would be an insurance case too. And the insurance company would press charges too, to get back their money. Poor guy! He needs help. Here he would have been given help if he got in prison. |

Sorry to hear about this Karen. We have tenants and have been lucky so far, but it seems I'm always fixing somethiing! You should be able to get rid of this guy. In New York it takes about 30 days (sometimes less, and sometimes more). We have a simple form here that is served on the tenant by the landlord. We've never had to use it yet, so I don't really know how good it works. You definitely have grounds to get rid of this bum. I don't know how Mass. law works, but you should be able to serve the eviction yourself without having to hire an attorney. Also, check your local small claims Court. You should also be able to sue for damages. Good luck, and have another margarita!

Thank you, Craig, for the link. I searched within that site, and since it's 5:30 AM right now and I'm still a bit groggy, my ability to comprehend is limited.
(boy... the Bailey's in my coffee this morning tastes especially wonderful!!! ) Just scanning it briefly, it seems B&E in the daytime without criminal intent might be the parameters under which this would fall. But just the same, there was damage. (I wonder what a jury would give me for my mental damages?)I'll be discussing all of this with my pal, George, the real estate guy who helped me find my house, knows the local systems, and probably has a handle on local eviction proceedings too. I don't really want to pursue pressing charges cuz hey, I don't need the hassle in my life, but if it's something that I can use to get the tenant's ass OUT of there more easily (i.e. "If you don't move, I'll press charges on the B&E.") without my violating some who-knows-what Mass. law (cuz as you know, the landlord is ALWAYS wrong and evil and vewwy vewwy baaaad), then it'll be good to know what I have in my back pocket should I need it. To answer other posts, yes, I do have a security deposit from the tenant which since it was taken about 15 years ago probably won't come close to what I'll pay out for the window repair and if you factor in my time and energy to clean up the mess. Right now I've got to remain focused on getting Apt. 3 ready for the girls to move in next weekend, so that's where I'll direct my energy. I don't want his actions to unnecessarily impact their joy and excitement at moving into their new place. They are both so psyched to have the apartment, and I'm so psyched that they are!! I've got numerous photos of the damage which I'll upload shortly to my PC. Not sure if I'll get my insurance company involved. I'll discuss that with George (who used to be in the insurance biz also). I'll post the "funny" pics of David and me looking all CSI a little later if I can. Thanks, everyone. I think right now I'll just worry about whether my lasagna and stuffed shells will be edible later this afternoon when 15 people show up for a party here!

Fun photos to share:
First he tried to break into his bedroom. Even had the presence of mind to put the album cover over the broken pane after the fact. Why should he be cold?? Yes, that dark smeared stuff is his blood. ![]() Apt. 3 (vacant apartment) bedroom. The dried blood on the floor doesn't really show up too much (it was 3 days ago), and doesn't give the full effect of the dog shit that I think he had on his shoes too. ![]() ![]() ![]() He even managed to get to the other end of Apt. 3 and get blood on the bathroom floor. Even tracked in some broken glass too to make it look really nice. ![]() After the clean up, it was time for "hey, let's pose with our CSI gloves!!". About 10 minutes after this was taken, David had me sucking down a margarita. Perhaps it was my hysterical laughter that made him think it was a good idea to get me a cocktail?? ![]() ![]() ![]() I think David planned his outfit around the fact that I told him he'd be wearing blue crime scene gloves, courtesy of the local PD: ![]() All ready and waiting for the wind and rain due to arrive later today. ![]() ![]() |

Holy crap Karen..... this is terrible. So glad this was at your old place and not the new home and that nobody was hurt (with the exception of your mental trauma and hang over from margherita-guzzing obviously). But what a piece of garbage that guys is. Sue the bastard I say. Sue, sue, sue. The arse off him. Oh and evict his sorry backside too. Evict, evict, evict.

Karen, I have not read the whole thread yet (just the first page). I hope you kick this bum out. I sitting here reading the first page and I'm pissed. He deserves to be kicked to the street. No doubt you will always have a problem with him if you don't.
