It all depends on how the mother's lease/tenancy-at-will agreement is written (i.e. what was signed upon move-in). The "usual" is 30-days notice, and if her rent runs from the 1st to the 30th/31st, then the landlord would be entitled to expect rent to be paid on January 1st for the month of January.
What I don't understand is the reference to the security deposit being "kept". Again, there should be specific reference to it in whatever lease/TAW agreement was signed upon move-in. By Massachusetts law, the landlord has 30 days to return the security deposit after the tenant has vacated the premises, and if any $$ is held back for damage or unpaid utilities, a full accounting needs to be provided by the landlord stating exactly how much was withheld and why.
Just because the manager has people "waiting in the wings" for the apartment should have no bearing on how soon the apartment should be vacated.
BK.... I'm so sorry that all this is coming down on you at once. If paying the rent for January isn't an issue money-wise, I would think you'd certainly have the right to retain the apartment for another month and not feel so rushed to get this all done so immediately. As long as the rent is paid on time, the apartment should still be rightfully "yours" (i.e. your mother's).
