Not my field but it sure seems like a stretch to find a duty on behalf of the texter (sender of the text) to have known that the textee / driver was actually driving UNLESS, MAYBE if the textee / driver just texted "yeah I'm driving home from work right now" (as stated in the article). But even then, joint enterprise seems like a reach.

Interesting case. I bet law students today are learning about all sorts of interesting fact patterns and tort theories like this.

Thanks.. I found this very intresting due to the fact I'm a service tech and I drive around a lot of the day and I'm constantly being paged or called on my cell phone from work,wife,customers,kids...

I hope the judge laughs in his face and throws it out....totally ridiculous.

The onus and responsibility is of course on the driver to be smart enough to not use or look at their phone while driving. Period. Put in your trunk or backseat if you just can't help but glance at it.

How anyone would think any fault lies at all with the person sending texts to someone driving is just beyond me.

i agree the driver should be sued not the caller. if youre driving the car you can easily pull over the side to take the call. dont answer or read while driving.

I like the bumper sticker that says "Hang up and drive". We could use a sticker like that here in Playa - let's see, in Spanish, that would be (maybe) "Cuelge y manejar!" - kinda loses some of the old punch in Spanish, though (or at least in my wonky Spanish - feel free to correct).

Maybe there should be a thread on "bumper stickers" (and probably already has been - r.i.p. - that I missed), including some other "happy motoring!" reminders along the lines of "Get that dog out of your lap" and other fair play issues. Which reminds me of the old joke about the guy who comes home early and finds his wife in bed with his best friend. He yells at his wife, tells her to leave and never come back, etc., then turns to his best friend, shakes his finger at him, and says "Bad Dog! Bad Dog!" (I've been dying to tell that dumb joke - seems like as circuitous a path to it as any. Happy motoring!)

whoever invents a cheap cell phone zapper will get rich. I would love to have one just to shoot at those idiots when they are driving and on the phone..Knock their ass off the air.
If a driver is in front of me at a stop light and on the phone..My hand is on the horn ready to pounce on them when the light turns green..And I blast the horn for a long time. Then I make the signal to "hang-up".

People who drive while use the cell phone or texting are selfish, arrogant dickfores...nothing is that important. You know who you are!!! Pull the hell over and get off the roads.
